I. Conditions of use:

1. Introduction

This website (Site) is owned and operated by Brita Water Filter Systems Limited (Brita). In consideration of making the Site available to you free of charge you agree that by accessing and using the Site you will be bound by these terms and conditions (“the Terms”). These Terms apply to the entire contents of the Site and to any correspondence by e-mail between you and Brita. Please read these terms carefully before using Site. Nothing in these Conditions shall affect your statutory rights as a consumer.

We may at any time and from time to time make changes to any part of the Site and these Terms and you will be bound by changes to these Terms from the time you next access the Site. No purported modification of these Terms by you will be effective unless and until it is countersigned by Brita.

2. Links to other websites:

Brita does not monitor the content of third party websites and any links provided on the Site are for your convenience only. Brita makes no representation or warranty as to the content of such third party websites. Brita excludes all liability for any third party material made available on the Site or contained on any third party website that it links to. Any contract concluded with a third party company will be between you and that company only and will be subject to their terms and conditions. You are responsible for viewing and abiding by the privacy statements and terms of use posted at the linked sites.

3. Using our web site

3.1 Permission to use Brita’s website

The copyright, trade marks, domain names and other intellectual property rights (“Intellectual Property Rights”) in all material and information on the Site (“the Content”) belongs to Brita or (if it has been licensed to us) to the licensor. All rights are reserved.

Nothing on the Site should be construed as granting (by implication, estoppel or otherwise) any licence or right to use any Intellectual Property Rights displayed on the Site, without written permission from Brita. Brita’s name may not be used in any way, including in advertising or publicity pertaining to distribution of materials on the Site, without Brita’s prior written permission.

You are permitted to view, print and downloaded the Content solely on the basis that:

(1) the Content may only be used for private, non-commercial purposes and not reproduced, exhibited, distributed or otherwise used for any public or commercial purposes;

(2) you may not in any way change the Content;

(3) you may not use or apply in any way any of the trade marks, logos or identifying marks appearing on the Site;

(4) the Content may not be used on any other websites, networked computers and/or in any public or private electronic retrieval system without Brita’s prior written permission;

(5) if you download or print off copies of the Content you must retain any copyright or other Intellectual Property Right notices contained in such material.

You may not copy, distribute or display the Site or any part of it to third parties. You may not link to any part of the Site. Any infringement of any Intellectual Property Rights in this manner may result in appropriate legal action being taken against you. All other rights are reserved.

You must ensure that any software downloaded from the Site (“Software”) to your computer is suitable for use on your computer and that it is free from viruses. It is solely your responsibility to virus check all Software loaded from the Site and to check it is compatible with your computer.

3.2 Your conduct on Brita’s website

You may not misuse the Site and, in particular, are forbidden from using the Site for any illegal and/or criminal conduct or to display or distribute illegal and/or offensive material. Brita reserves the right to delete any content (including any of the Content) at its sole discretion. Furthermore Brita reserves the right to bar users who infringe these Terms from using any of the services offered on the Site.

Any user contributions posted on the Site do not reflect Brita’s views. Brita will co-operate fully with any law enforcement authorities or court order requesting or directing Brita to disclose the identity or to locate anyone posting any material or using the Site in breach of these Terms.

3.3 Downloading

Any software downloaded from the Site is downloaded at your own risk. BRITA accepts no liability for damage caused from installing and/or using any such software. It is solely your responsibility to virus check all software downloaded from the Site and to check it is compatible with your computer.

4. Information Management and Security

Brita will use any personal data collected during your use of the Site in accordance with Brita’s privacy policy (see Part II below). However, if while using the services offered on the Site you make your mobile number and/or e-mail address generally available, Brita will not responsible for the consequences resulting from this.

When Brita asks you to submit financial information (such as your credit or debit card number) when ordering any goods and/or services from the Site, Brita uses industry standard technology for secure commercial transactions which encrypts data, including your credit or debit card number. Brita, however, will not be liable for any unauthorised transactions made using your personal or financial details.

5. Disclaimer:

Whilst Brita uses its reasonable endeavours to ensure that the Content is compiled with skill and care and that the Content is up to date and correct, Brita gives no warranty as to the accuracy or completeness of the Content or of its suitability for specific purposes. The Content is for your general information and is used solely at your own risk.

The material on Brita’s website is provided “as is”, without any conditions, warranties or other terms of any kind. Accordingly, Brita provides the Site on the basis that all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill) are excluded to the fullest extent permitted in law.

Whilst Brita uses its reasonable endeavours to ensure that the Site is normally available 24 hours a day, Brita shall not be liable if for any reason the Site is unavailable at any time or for any period. Access to Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Brita’s control. Brita reserves the right to modify or withdraw, temporarily or permanently, the Site (or any part thereof) with or without notice and shall not be liable to you or any third party for any modification or withdrawal of the Site.

6. Liability:

Brita and any of Brita’s group companies (and each of their officers, employees, shareholders, subcontractors and agents) exclude all liability and responsibility for any loss or damage that may in any way result to you or a third party in connection with the use, inability to use or the results of use of the Site and any websites linked to the Site including, without limitation, any loss or damage due to viruses, software, data or other property on account of your access to, use of, or browsing the Site or your downloading of any material from the Site or any websites linked to the Site.

Nothing in the Terms shall exclude or limit Brita’s liability for death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977) or fraud, misrepresentation as to a fundamental matter, or any liability, which cannot be excluded or limited under law.

7. Governing Law and Jurisdiction:

These terms and conditions are governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions or the Site shall be subject to the non-exclusive jurisdiction of the English courts.

II. Privacy Policy and Data protection Conditions:

1. General:

When you register and/or order goods and services on the Site, Brita collect information about you which may include but shall not be limited to: your name, company name/details (where applicable), address and post code and, where applicable, may also include telephone and fax numbers, email address, type of company (where applicable) and number of offices (where applicable) (your information). Brita collects your information to allow it to process your registration and any requests you may make. Your information is then used by Brita, its agents and sub-contractors to communicate with you on any matter relating to your registration and/or the provision of the goods and/or services to you. You must therefore read this privacy policy to understand Brita’s data processing practices, how Brita uses your information and how you can instruct Brita if you prefer to limit the use by Brita of your information.

2. Use of your Information

Brita would like to make your information available to other companies within the Brita Group and/or to third parties for marketing purposes. Brita shall only use your information for such purposes if you give your express permission for this. To do this, where your information is collected on the Site, you have the option of giving your permission to Brita using your information for such marketing purposes. You can withdraw your permission at a later data by sending us an e-mail or a letter. Normally, Brita does not require you to enter any information in order to use the Site; this means that the Site can be called up without the need to register first.

3. Data Protection:

Brita will store your information in automated files and will process and use your information accordingly to process your order. Brita is bound by and complies with the Data Protection Act 1998 which relates to storage and disclosure of your information that is personal to you. Similarly, Brita Group companies outside the United Kingdom are bound by the relevant national and international data protection regulations in force. Brita will therefore deal with your information responsibly. By registering or ordering goods and services on the Site, you consent to Brita using your information for marketing purposes within the Brita Group of Companies.

3. Confidentiality:

Whilst Brita intends to ensure your information is kept confidential, Brita cannot guarantee that loss, misuse or alteration of your information will not occur but it will use its reasonable endeavours to prevent this from happening. Brita would particularly like to draw your attention to the fact that children under the age of 18 should not submit personal details to the website without a parent's or guardian's permission.

4. Cookies:

" Cookies" are small text files that are sent to your web browser from a web server and stored on your computer's hard drive. This allows the server to collect information from the browser and therefore makes it easier to use online offers. Unless it is strictly necessary for specific applications, any cookies used by Brita do not contain any personal information so that your privacy remains protected. Most web browsers accept cookies automatically but you can change your browser's settings to prevent this.

5. Security:

Brita places a very high value on the security of your information. You should be aware however that any information you transmit over the Internet to Brita is only protected if the address line begins with “www.britafiltertaps.co.uk”. The data transfer is then securely protected from unauthorised reading by third parties by the SSL (Secure Socket Layer) security procedure together with 128 bit encoding. If this option has not been activated, when sending personal information over the internet (including via e-mail) your information will not be secure.

6. Sale of business:

If Brita is sold or integrated with another business your information may be disclosed to our advisers and any prospective purchasers and their advisers and will be passed on to the new owners of the business.

7. Updating, correcting and deleting your details:

If any of your information changes, for example if you change your e-mail address, name or payment details, please let Brita know the correct details by sending an e-mail to customercare@taps.brita.co.uk or by sending a letter to Freepost, RLZS-YGLS-ZLGL, Brita, Coleville LE67 1T

8. Your consent:

By submitting your information to Brita you consent to opt into the use of your information in accordance with this policy. If Brita changes its privacy policy, Brita will post the changes on this page, and may place notices on other pages of the Site so that you may be aware of the information Brita collects and how it is used at all times. Continued use of the Site will signify that you agree to any such changes.
Owing to the global nature of the Internet infrastructure, the information you provide may be transferred in transit to countries outside the European Economic Area that do not have similar protections in place regarding your data and its use as set out in this policy. However, Brita have taken the steps outlined above to try to improve the security of your information. By submitting your information you consent to these transfers.

9. Disclosure:

Brita reserves the right to disclose your information in cases in which Brita have reason to believe that such disclosure is necessary to identify, contact or commence proceedings against someone who may be in breach of the Terms or may be causing injury to or interference with (either intentionally or unintentionally) Brita’s rights or property, or anyone else who could be harmed by such activities. Brita further reserves the right to disclose or access your information when the law requires it and for administrative and other purposes that Brita deems necessary to maintain, service, and improve Brita’s products and services.

10. Links:

Advertisers or web sites that have links on the Site may collect personally identifiable information about you. Your registration with Brita constitutes your express consent to the collection of such personally identifiable information in such circumstances. The data protection practices, if any, of those web sites linked to Brita’s website, or websites of any Brita Group company, are not covered by this privacy statement.
